1. These Terms Govern Every Sale
These terms apply to every animal sold by Tosetti Pythons & Boas ("Seller"), whether through MorphMarket, tosettireptiles.com, social media, or in person. Sending a deposit or payment, winning an auction, or taking possession of an animal is acceptance of these terms by the buyer ("Buyer"). No signature is required. The version posted at the time of payment applies to the sale.
For sales made through MorphMarket, these terms are Seller's Store Policy and override MorphMarket's Default Store Policy on every point they address, to the fullest extent MorphMarket's rules allow. Details stated in a specific listing or in Seller's written messages before payment (for example, a lab-confirmed sex) also form part of the sale.
2. All Sales Are Final
All sales of live animals are final. Seller does not accept returns for change of mind, including Buyer's inability or unwillingness to house, feed, or care for the animal, incompatibility with other animals, or any condition, feeding change, or event arising after transfer. The only exceptions are the remedies expressly stated in Sections 3, 5, 6, 7, and 8.
3. Payment and Deposits
Payment in full is required before an animal is released or shipped. Checks and other payments must fully clear first.
Accepted payment methods: PayPal (Goods & Services or Friends & Family), Venmo, Zelle, Cash App, personal check, or money order; cash for local pickup. Buyer pays any transaction fees.
A 20% non-refundable deposit holds an animal for up to 7 days.
Payment plans, if offered, require the 20% non-refundable deposit with the balance paid within 45 days. The animal is released only after the final payment.
If Buyer misses a payment, backs out, violates these terms, or does not respond to Seller for 10 days, Buyer is considered to have backed out: the deposit is forfeited and any payments beyond the deposit are refunded.
If Seller cancels a sale for any reason, Buyer receives 100% of all amounts paid.
Auction wins must be paid in full within 1 business day unless otherwise agreed in writing.
Any refund owed under these terms is issued within 7 days of it becoming due, or of the animal being returned to Seller when a return is required.
4. Shipping and Pickup
Local pickup: Buyer inspects the animal at pickup. By accepting it, Buyer confirms it appears healthy and accepts it as-is, and Seller's obligations end at the moment of transfer.
Animals ship only via FedEx Priority Overnight, Monday through Wednesday, to a staffed FedEx location for Hold at Location pickup. No residential or doorstep delivery.
Seller chooses the ship date, carrier, and destination and ships only when forecast temperatures at both origin and destination are between 40°F and 90°F for the full transit. Weather delays are not a breach; Seller will keep Buyer informed. Buyer's payment accepts this.
Shipping is included for green tree pythons unless the listing says otherwise; other animals ship as listed. Shipping charges are non-refundable once the shipment is booked, except under Section 5.
Seller sends tracking the day the animal ships. Buyer must be available to collect the package the day it arrives.
5. Live Arrival Guarantee (Shipped Animals Only)
Seller guarantees that a shipped animal will arrive alive when all of the following are met:
Forecast temperatures stayed within 40°F–90°F during transit.
The package was picked up within 2 hours of being available (or of the location opening), and the animal was unboxed and inspected immediately.
Seller was notified within 2 hours of pickup with clear photos or video of the animal on top of the shipping box with the label visible, and Buyer kept the box.
If these conditions are not met, including any request for residential delivery, a late pickup, or missing evidence, the guarantee is void. For a valid claim, Buyer receives a full refund of the purchase price and shipping paid, or a replacement animal of comparable value if Buyer prefers one.
6. Health and Condition
Animals leave healthy, free of mites and other visible external parasites, and feeding consistently on their own. Animals are sold established and are not shipped before they are feeding on their own. Feeding records are available on request.
Buyer must report any health concern within 48 hours of receiving the animal, with photos or video. A substantiated claim receives a full refund when the animal is returned (Seller provides the return label) or an agreed replacement.
After 48 hours, all care and its outcomes are Buyer's responsibility. Seller is not responsible for feeding refusal after the move (common and normal in green tree pythons), failure to thrive, temperament, refusal to breed, or husbandry outcomes.
A veterinary health certificate can be arranged before transfer on request, at Buyer's expense.
7. The Animal You Receive
Buyer receives the exact animal pictured, unless a listing is marked as an example photo. The Animal ID in the listing matches the photos and paperwork. If the wrong animal is sent, Buyer must notify Seller within 48 hours with photos; Seller will send the correct animal or give a full refund when the animal is returned, and pays shipping both ways.
Weights and lengths are approximate and are not guaranteed.
Animals change in color and appearance as they grow and shed. Listing photos may not show the animal's exact current look; Buyer should request updated photos before paying if that matters to them.
Lineage and genetics are as documented. Buyer is responsible for understanding the traits they are buying. Adult color and predictions about future offspring are based on the documented lineage and are not guaranteed.
Seller provides the breeder record and lineage documentation, and for Cyclops-locality green tree pythons, a copy of the proof-of-origin paperwork.
8. Sex and Testing
Neonates and young animals are sold unsexed unless the listing states a lab shed-sex result. Seller does not probe or pop young animals.
Shed sex testing and nidovirus testing can be arranged on request before shipping, at Buyer's expense. Results are shared with Buyer.
If an animal sold with a stated lab-sex result proves to be the wrong sex, Buyer must notify Seller within 7 days of receipt for a full refund when the animal is returned (Seller provides the return label). Otherwise, sex is not grounds for a return or refund.
9. Buyer's Responsibilities
Buyer is at least 18 years old.
Buyer has confirmed the animal is legal to own and transport where they live, including any federal, state, or local permits or restrictions.
Buyer has the knowledge and a suitable, ready enclosure before the animal ships.
Buyer is strongly encouraged to quarantine new animals for 60–90 days and to have a qualified exotics veterinarian.
10. Ongoing Support
Seller offers free care and feeding advice by email (jimtosetti@gmail.com), text, or phone for as long as Buyer owns the animal. This support is advisory only and does not extend any guarantee period or create any warranty or refund right.
11. Limitation of Liability
Seller's total liability for any claim arising from a sale is limited to the purchase price and shipping actually paid. Seller is not liable for veterinary costs, lost time, or any indirect, incidental, or consequential damages, or for any loss after transfer except as provided in these terms.
12. Disputes and Governing Law
Buyer agrees to contact Seller first and resolve any concern in good faith. For MorphMarket sales, unresolved issues go through MorphMarket's dispute process, not a payment-processor chargeback. These terms are governed by the laws of North Carolina, and any court action shall be brought in Gaston County, North Carolina.
